Terms of Service

These Terms of Service (“Terms”) govern telokind.com and the Telokind content, accounts, planning tools, AI-assisted features, and related services (collectively, the “Service”).

Telokind is currently a founder-operated, unincorporated service. In these Terms, “Telokind,” “we,” “us,” and “our” refer to the individual operator of the Service.

You agree to these Terms when you create an account, affirmatively select a control presented with these Terms, use an interactive feature after being given notice of them, or otherwise expressly accept them. Merely viewing a public informational page does not by itself indicate acceptance.

Our Privacy Policy explains how we handle personal information. If you do not agree to these Terms, do not create an account or use an interactive feature.

1. Eligibility and launch market

To use an account, cloud synchronization, or AI feature, you must:

• be at least 18 years old;
• be legally capable of entering into these Terms;
• live in the United States; and
• use the Service only where doing so is lawful.

Public informational pages may be viewed elsewhere where lawful. We may use an age or residence self-confirmation and reasonable account or security signals to apply these eligibility rules; we do not require a full birth date for this purpose.

The consumer Service is for personal and household use. Business, employer, school, government, API, administrator, or enterprise use requires our written authorization and may require separate terms.

2. Current open access and future paid features

The current release is provided on an open-access basis. Telokind does not currently offer live checkout, paid subscriptions, paid one-time purchases, automatic renewal, or a referral reward program.

Using the current free Service does not authorize Telokind to charge you later. We will not convert open access into an automatic charge, enroll you in a paid plan, or charge a stored payment method merely because you previously used a free feature.

Telokind may introduce paid features, usage limits, or a referral program in the future. Before a paid transaction or referral program applies to you, we will present the applicable price, taxes, scope, duration, renewal terms if any, material restrictions, refund terms, and program rules, and obtain any acceptance or payment authorization required by law. We will update these Terms or provide additional terms before enabling those features.

Open access is not a promise that every feature will remain available, unlimited, or free forever.

3. What Telokind is—and is not

Telokind is an educational, planning, and self-reflection tool. It can help you explore life roles and goals, organize a personal Path and Evidence, and receive optional AI-assisted questions, suggestions, and reviews.

Telokind does not choose your goals, score your worth, predict your future, guarantee an outcome, or silently change a saved Path. You decide whether to accept, edit, reject, or act on any suggestion.

The Service is not medical care, mental-health treatment, therapy, diagnosis, crisis counseling, legal advice, financial or investment advice, immigration advice, employment advice, or another professional service. It is not designed for emergencies or high-impact decisions about another person.

4. Guest use and accounts

4.1 Guest use

Some public content and drafting may be available without an account. A guest draft may remain only in your browser or device until you clear it, overwrite it, or the browser or device removes it.

Clearing browser data, using private browsing, changing devices, storage limits, or technical failure may delete a local draft. To the extent permitted by law, Telokind is not responsible for a local draft that it never received or controlled.

4.2 Accounts

Some features require an account. You must provide accurate information, protect your sign-in method, and promptly notify telokind@gmail.com if you suspect unauthorized access.

Authentication may be provided by an external authentication provider and an enabled identity provider such as Google. Those services may have their own terms and privacy notices.

Do not sell, rent, transfer, share, or misuse an account, and do not use another person’s account without authority.

5. Your Content

“Your Content” includes your Life Role and Ultimate Goal choices, Paths, Success Evidence, Current Position, Route Bets, Current Moves, notes, prompts, AI conversations, files, feedback, and other material you submit to the Service.

You retain any rights you already have in Your Content. You are responsible for Your Content and must have the rights and authority needed to submit it.

You grant Telokind a limited, worldwide, non-exclusive license to host, reproduce, transmit, format, analyze, display to you, and otherwise process Your Content only as reasonably necessary to:

• provide and maintain the features you request;
• generate and store AI-assisted results you request;
• authenticate, secure, troubleshoot, and prevent abuse of the Service;
• comply with law and enforce these Terms; and
• create and use aggregated or de-identified operational information that is not reasonably linkable to you to understand and improve the Service.

This license does not authorize Telokind to use private Your Content in advertising or public marketing. It ends when the relevant content is deleted from systems we control, subject to provider, backup, security, dispute, and legal-retention rules described in our Privacy Policy.

Content that another person already copied from a share link is outside our control. Do not submit another person’s sensitive information without authority or content you do not want processed by providers needed for a feature you request.

6. AI features and output

6.1 Automated service

AI features are optional and run only when you request them. AI output is generated automatically and may be inaccurate, incomplete, outdated, biased, inappropriate, or based on a misunderstanding. Other users may receive the same or similar output, and output may not be unique or eligible for intellectual-property protection.

Commercial AI API providers may apply automated safety filters and may temporarily retain or permit limited access to request data for security, abuse prevention, support, service operation, or legal compliance. Telokind does not continuously monitor Your Content, and no person reviews every AI interaction.

Use the non-AI parts of the Service if you do not want selected content processed by an AI provider.

6.2 Training boundary

Telokind does not use private Your Content to train its own general-purpose or cross-user foundation model.

We use commercial AI API offerings and, where available, select terms and settings designed to limit use of API inputs and outputs for general-purpose model training. We do not intentionally opt private Your Content into a provider’s voluntary model-improvement or training program.

Any future proposed use of identifiable private Your Content for a materially different training purpose will be subject to an appropriate separate notice and any affirmative choice required by law.

6.3 Output rights

Subject to these Terms and applicable law, as between you and Telokind, you may use output generated specifically for you. We assign to you any rights in that output that we may have.

This does not transfer rights in Telokind’s software, branding, product design, templates, or protectable selection, arrangement, and expression of its Life Role, Ultimate Goal, Path, and Field Guide materials.

We do not guarantee that output is original, non-infringing, accurate, complete, or fit for a particular purpose. You must review output before using, publishing, or acting on it.

7. Acceptable use

You may not use the Service to:

• violate law or another person’s rights;
• exploit, endanger, sexualize, or facilitate abuse of a minor;
• threaten, facilitate, or meaningfully assist violence, self-harm, serious wrongdoing, fraud, or illegal activity;
• distribute malware, phishing, spam, or other deceptive or harmful material;
• impersonate another person or falsely present AI output as verified professional judgment;
• access another person’s account or private information without authority;
• interfere with, overload, probe, or evade the Service’s access controls, rate limits, safeguards, or security;
• make automated high-impact decisions about another person in health, employment, housing, education, credit, insurance, legal services, or access to essential services; or
• use automated access, scraping, or bulk extraction without our prior written authorization.

You may not reverse engineer or attempt to extract source code, non-public system instructions, private datasets, model weights, or security mechanisms except to the extent a restriction is prohibited by law.

8. Telokind intellectual property and feedback

Telokind and its licensors own the Service, including its software, branding, product design, templates, public editorial content, and protectable expression and selection or arrangement of Life Role, Ultimate Goal, Path, and Field Guide materials, excluding Your Content and rights expressly assigned under Section 6.

We grant you a personal, limited, non-exclusive, non-transferable, revocable right to use the Service under these Terms.

If you intentionally submit product feedback, you grant Telokind a worldwide, perpetual, irrevocable, royalty-free license to use that feedback to operate and improve the Service. This feedback license does not turn private Path, Evidence, prompt, or review text attached to a support request into advertising or model-training material.

To report claimed infringement, email telokind@gmail.com with enough information for us to identify the material, the right involved, and how to contact you.

9. Privacy and security

Our Privacy Policy explains how we handle personal information, including User Content, optional AI processing, local storage, and consumer health data. A privacy policy is a notice and is not consent to a use that legally requires a separate affirmative choice.

We use safeguards designed for the nature and risk of the information, but no Internet service is completely secure. Use care before entering sensitive information. Contact telokind@gmail.com if you believe an account or information has been compromised.

10. Professional and emergency limitations

AI is not a human adviser. Verify important information independently and consult a qualified professional when appropriate.

Do not rely solely on Telokind for decisions materially affecting health or safety, treatment, medication, legal rights, immigration, finances, investments, credit, insurance, housing, education, employment, or another person’s access to essential services.

Telokind does not continuously monitor Your Content, provide crisis counseling, or contact emergency services or another person for you. AI safety filters can fail to detect risk.

If you or someone else may be in immediate danger in the United States, call 911. Call or text 988 for the Suicide & Crisis Lifeline.

11. Third-party services and content

The Service relies on third parties for authentication, hosting, databases, AI processing, email, security, analytics, and error diagnostics. A third party you interact with directly may have its own terms and privacy notice.

Telokind remains responsible for selecting and directing service providers to the extent required by law but does not control an independent external site or service you choose to visit.

Public examples and Path scenarios may be fictional or editorial composites. They are not testimonials or promises of results unless clearly identified otherwise.

12. Beta features, changes, and availability

The Service may contain beta, preview, trial, or experimental features that are incomplete, change, or fail. We may add, modify, suspend, limit, or discontinue a feature to improve the Service, address security or legal needs, prevent abuse, or respond to business conditions.

We do not guarantee uninterrupted or error-free availability. Scheduled or emergency maintenance, provider failures, network events, security incidents, or events beyond our reasonable control may affect access.

Where reasonably practicable, we will provide notice of a material discontinuation. Any future paid feature will be subject to the additional terms and remedies disclosed for that feature.

13. Suspension, termination, and deletion

You may stop using the Service at any time and may request account deletion through available controls or by emailing telokind@gmail.com.

We may suspend, limit, or terminate access when reasonably necessary to address a material breach, security risk, fraud, illegal use, harm, provider requirement, or legal obligation. Where appropriate and legally permitted, we will give notice and an opportunity to appeal. Immediate action may be necessary for urgent security, fraud, or safety risks.

Termination does not automatically erase security, dispute, or other records that we are permitted or required to retain. Sections that by their nature should survive—including ownership, disclaimers, liability limits, dispute terms, and lawful retention—continue after termination.

14. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TELOKIND DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT.

TELOKIND DOES NOT WARRANT THAT THE SERVICE OR OUTPUT WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, UNIQUE, ACCURATE, COMPLETE, OR SUITABLE FOR YOUR CIRCUMSTANCES, OR THAT IT WILL PRODUCE A PARTICULAR LIFE, CAREER, HEALTH, RELATIONSHIP, OR FINANCIAL OUTCOME.

Some jurisdictions do not allow certain disclaimers. In those jurisdictions, this Section applies only to the extent permitted and does not limit a right that cannot lawfully be waived.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TELOKIND WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OPPORTUNITIES, GOODWILL, OR DATA, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED THAT SUCH DAMAGE WAS POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TELOKIND’S TOTAL LIABILITY ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF USD $100 OR THE AMOUNT YOU PAID TELOKIND FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These limits do not apply to fraud, willful misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence where it cannot be limited, or any liability or consumer remedy that law does not permit us to exclude or limit.

16. Your responsibility for unlawful use

To the extent permitted by law, you are responsible for claims, losses, and reasonable costs arising from Your Content or your intentional unlawful use of the Service, material violation of another person’s rights, or serious violation of Section 7.

This does not require you to cover a claim caused by Telokind’s own wrongdoing and does not limit a non-waivable consumer right.

17. Disputes and applicable law

You may email telokind@gmail.com to seek an informal resolution. Doing so is voluntary and does not change any legal right or deadline.

These Terms are governed by the law that applies under applicable conflict-of-law and consumer-protection rules. Courts having jurisdiction under applicable law may hear disputes. No court is made exclusive by these Terms, and these Terms do not require pre-dispute arbitration or waive participation in a class proceeding.

Either party may seek urgent injunctive or equitable relief where legally available. Nothing in these Terms limits access to small-claims court or another forum that applicable law makes available.

18. Changes to these Terms

We may update these Terms as the Service, business, or law changes. The updated version will show a new effective date. We will provide additional notice and request new acceptance when required for a material change.

Changes apply prospectively. We will not use a Terms update by itself to impose a charge for prior free use or to remove a right that applicable law protects.

19. General terms

If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. Headings are for convenience.

You may not assign these Terms or an account without our written consent. Telokind may assign these Terms in connection with a financing, reorganization, transfer of the Service, merger, acquisition, or sale of assets, subject to applicable notice and privacy obligations.

These Terms, together with any additional terms that we expressly present and you accept for a particular feature, are the agreement about the current Service. Our Privacy Policy describes our data practices; it does not replace a separate choice where applicable law requires one. The English version controls to the extent permitted by law.
